On April 5th, 2017, the Evans Town Board held a public hearing to rezone property on Erie Road (Route 5). Late in 2016, the Zoning Board of Appeals (ZBA) apparently held a public hearing to rezone the unalienated parcel once part of the deed description of Lake Erie Beach Park. Neither the ZBA meeting nor the public hearing were advertised. Isn’t this in conflict with the NYS open meetings law?

Why, on a controversial parcel, wasn’t the public allowed to voice their and concerns at a public hearing?

The town’s Local Waterfront Revitalization Program requires the town board to return the parcel to public use.

Maybe if you are going to break laws, it’s better to go for the hat trick?
